What is Unlawful Dismissal?
Unlawful dismissal occurs where the dismissal is not only unfair but against an already established law. Application for unlawful dismissal must be lodged within 60 days of dismissal. The reasons for unlawful dismissal differ slightly to those for unfair dismissal. They include:
- Discrimination: sex, colour, race, age etc.
- Temporary absence from work due to illness/injury
- Trade union participation/lack of trade union participation
- Seeking the position of/acting as a representative of employees.
- Maternity/Parental leave absence
- Temporary absence from work to engage in a voluntary emergency management activity.
- Filing a complaint/commencing proceedings against an employer.
